Legal Question in Credit and Debt Law in Florida

Will my Ex-wife be responsible for half of the remainder of a repossession debt.

After our divorce my wife took possession of a vehicle that is in both of our names, title and loan. She quit making the payments, and the vehicle got repossessed. The bank is going to make me pay the remainder of the debt after they auction off the vehicle. I am the primary on the loan. Can I legally make her responsible for half of the remainder since she is also on the loan? We were married in Fla. and the loan was made in Wyoming.

If your wife lives in WY you may file an action against you in what is

essentially a small claims court. If she was specifically ordered,

in your divorce decree, to make the payments on this vehicle, you

can ask the court to find her in contempt and enter a judgment in your

favor for the amount you have had to pay to clear this up. [If you do

this, make sure YOU have completely complied with the decree first.]

You may then collect the amount you are owed by

garnishing her wages or attaching some of her property.

The unfortunate result of this repossession will be reflected on your

credit report. You should write the credit reporting agencies and ask

them to include your explanation with any report they make.
