Legal Question in Credit and Debt Law in Florida

Writ of Garnishments

What if they claim they served you with a summons to appear in court a year ago and you never received it and they can't show proof that you signed for it? Also the debt was made fraudently by ''people'' who stole my identity over 5 years ago. How should I fight this? I am NOT going to pay for a debt that is not legally mine. Is there anything more that I can do? PLEASE HELP!

Re: Writ of Garnishments

If they did not serve you, did they serve someone in your household over the age of 15? If so, that is good service. Otherwise, no.

ID theft is tricky business. Did you report the wrongful charges in writing? Sign an affidavit, etc? see www.ConsumerLawyerHelp.com for links to this area of law and for help.
