Legal Question in Credit and Debt Law in Florida

About a year and a half ago I had got behind on my credit card payments with capital one. So I set up payments for a year for them to take money out my bank account for. However this entire time I was making payments they never sent me any statements or anything showing that I was paying them and I tried contacting them for months without any luck. So for all I know they could have me paying more than I really owe. Once that year was up I was contacted by them to set up payments again and I did. However a month or two after doing this which was february of this year someone committed fraud on my bank account,so I close my bank account, had to wait for them to give me my money back, and I contacted my credit card company and informed them about this. Due to this happening which was at the end of the month I got behind on some of my other bills which were my rent and light bill and had to pay late fees. So I have been having a hard time catching up and have not been able to pay them. To top it off my rent just went up a $100. I recently was contacted by a lawyer representing them saying I owe them $4700 and I offer to pay them $100 to avoid going to court but they still wanted me to pay more which I am not able to do at the time so my question to you is what should I do about this situation?

pay what you agreed to pay. If the lawyer contacts you again, tell him that you are paying what you can and thank him for calling. The worst they can do is file a small claims action - but luck is on your side since you are paying something to them. The judge will find this a frivolous law suit and probably cancel you debt. So hang in there -
