Legal Question in Credit and Debt Law in Florida
After a year of making payments on a hospital bill, I'm turned over to collectio
I have been making regular monthly payments of $20.00 (twenty dollars) per mo. on a hospital bill with the original amount of $1315,00 (thirteen hundred and fifteen dollars) with Bon Secoures St. Josephs Hospital of Port Charlotte, Florida, religiously on the 1st. of every month since 04/02/2001, all of my checks have been accepted and cashed, now suddenly my account has been turned over for collection with ACE ( an acronym for Associated Creditors Exchange, Inc.) of Phoenix, AZ..
(NOTE:) My total income is a VA check for $398.00 mo.
My real question at this point is, can they leaally change the accepted payment rules that we've established on me now, and if not how do I go about straightening it out with the collection agency that is now involved.
I would be most grateful to you for any information and, or advice you might be able to furnish me.

Yes they can. With hospital debts they are due upon receipt of service. You have been making payments and they have been accepting them but obviously they want additional monies. I would tell the collection agency that is the amount you can pay. They will try to squeeze additional money out of you and you have to stay firm. Keep making payments. Now they can also file a lawsuit against you for the balance but that will take at least another 10 months. A crditor is not obliged to accept payments on account. Your attempts to convince the agency to keep you on the same plan will probably meet with no success. You,most likely, are better to wait to be sued nd tell the judge your plight. The judge is more apt to allow such a meek payment plan. Good luck.
