Legal Question in Criminal Law in Florida
893.13(6a) cocaine-possess-possess cocaine
My wife was charged with this, she had no idea the passenger had cocaine and then hid it under the seat when they were pulled over, in addition she heard the cop asking the passenger over and over where did she get the drugs, the cops never asked my wife about the drugs, my wife did hear the passenger mention some names and the next thig she new she was handcuffed and taken to jail. In the report the passenger (lied) stated that my wife gave her the drugs to hide when they were being pulled over, which she did not. At the time they were pulled over my wife was driving, making an illegal left turn (which is when the cops showed up), over a median (no she was not drunk, left turns were allowed at one time then the city put in a small median) and putting on the head lights because she realized they were not on, there was no free hand to give the passenger anything.
On our own we had her take urine and hair drug test to prove she has no history of drug use.
we did speak to an attorney but he sounded more like she was already guilty and what could happen.
She has NO criminal history, nothing,
were scared, why is this so hopeless?

I don't think it is hopeless. The state has ti prove your wife knew about the drugs. Let me know where this occurred and whether you are looking for counsel.

I agree with Ms. Masters. It is NOT hopeless. Just because your wife was "arrested" and/or "charged" does NOT mean that she is guilty. The arrest and/or charge are just "allegations" that she may have committed a crime.
If she is NOT guilty of the charge, she should hire an experienced and aggressive criminal trial attorney who can defend her rights and try to get the State to drop the charge. A good defense would work on the case from this moment up until the point of having a trial, before a jury of her peers, if necessary.
My firm handles all types of drug offenses throughout the Tampa Bay area. Please visit my website at: www.slavinlawfirm.com for more information.
If you and/or your wife would like to discuss her case any further, please contact my office so she can start defending herself.
Good luck.
