Legal Question in Criminal Law in Florida
If someone has 2 counts of sale/delivery of cocaine and 1 count each of possesion of cocaine andpossesion of crack and they are a transient and indigent and they plead "no contest" what kind of sentance can they expect (Florida)
1 Answer from Attorneys
The sale and deliveries are 2nd degree felonies, the possession charges are 3rd degree felonies. The maximum for a 2nd degree felony is 15 years, and for a 3rd it is 5 years. So, the maximum is probably 40 years, but highly unlikely. Without a complete criminal history of the defendant, no attorney can score him or her pursuant to the sentencing guidelines. If it is a first time being in trouble, the chances of prison are much less. If this is not the first time, the defendant may be looking at prison, depending upon the score, the abilities of the defense attorney, the prosecutor, and the judge.
