Do i need an attorney this is my first offense in fla. and my girlfriend did not press charges it is the state against me

In a vast majority of domestic battery cases, the alleged victim recants or decides that they do not want to proceed with the prosecution after the arrest is made. The prosecuting authority is painfully aware of this fact and has manuals and training programs for their prosecutors teaching them how to proceed in a case with a non cooperative victim. Even though it is your first offense, your case should be handled by an attorney as soon as possible. An attorney can evaluate the evidence in your case and provide legal insight into the admissibility of evidence, contact the prosecutor with additional facts and provide reasons to dismiss the charge and effectively negotiate a resolution with the prosecutor or with the judge if necessary.

Since you posted your question under South Carolina you ended up with a lawyer from South Carolina. You need to post your question for a Florida lawyer as all state laws vary. If you have been charged with a criminal offense you really need to talk with an attorney.
