how can i get a 817.034 expunge . i need to have a tourney file a motion to change charge

You don't give enough information. Did you plead guilty or no contest to the charged statute? Did you get a withhold? Were charges dropped? An attorney can't just change the charges, usually only a prosecutor can. However, if you haven't pled yet and charges are pending, it may be possible for your attorney to convince the prosecutor to amend the charge. Your best bet is to contact an attorney in your area to see what, if anything, you are eligible to do.
