Legal Question in Criminal Law in Florida
2 Misdemeanors
Hi
First of all thank you for taking the time to read this email. I just found out that a family member was arrested a month ago and charge with 2 Misdemeanors.
1. Poss Cannabis/20 Grams or Less
2. Poss/Drug Paraphnalia
How bad are these misdemeanors if he is convicted. What should he do, his first arraignment is coming soon. Once again I want to thank you for taking the time to read this and helping us out.

He should hire a lawyer for his first appearance. He is facing jail time.

Both of these cases are misdemeanors of the first degree. Each is punishable by up to 1 year in jail, 1 year of probation, and/or a $1,00 fine. Also, if adjudicated guilty of teh marijuana charge, he is facing a two year license suspension
If this is his first offense it is highly unlikely he is facing jail time. However, an attorney should be retained so that any legal issues can be identified, and possibly a diversion program may be negotiated for him.

Richard Hornsby gave a great answer to your question - I can't think of a thing to add, which is rare.
Since I handle major felonies, I would not be the best attorney to handle this for your family member.
However, I do think your family member should hire an attorney and NOT rely on the Public Defender's Office. Public Defenders do an outstanding job, yet they are given a caseload that far exceeds what they should handle. A private lawyer will be able to provide a higher degree of personal service and devote more time to the case.
