Legal Question in Criminal Law in Florida
2nd violation of probation
My husband has violated his probation for the 2nd time. He is addicted to pain pills and has went through court ordered rehab. He could face up to 3 yrs prison. I am trying to get him help. Does the probation officer have to violate him?

Re: 2nd violation of probation
Hello: In response to your question, I have found that sometimes a Prob. Officer can allow some breaks, but you'd have to ask the person why there is a need to violate your Husb. in this instance. Since this is a 2d violation, the officer may not have had much choice. As you are probably aware, the nature of the violation (and the nature of the underlying charge that got him on prob.) matter in any possible sentence. Without knowing more about the case, I can't render any possible opinion of what may happen.
If my office can be of any assistance with this, please give us a call. Good luck. Tom Rosenblum
