Legal Question in Criminal Law in Florida
On 03/28/2014 my wife and daughter (who was questioned without asking for consent) at her school twice by the FBI were giver a subpoena to testify in front of a Grand Jury on 04/02/2014. Is my daughter entitled to have an attorney with her during questioning? She is a minor, does she even have to go?
1 Answer from Attorneys
Yes she must go. A parent may accompany. An attorney can also go, BUT the attorney can only watch because Grand Jury testimony is more complicated than in court testimony. Her age has a lot to do with what was asked of her previously but if she is testifying for a Grand Jury then it sounds like (but you must talk to an attorney to be sure), she is not a target of the investigation. Bottom line, getting an attorney is the best thing you can do for your daughter right now.
