Legal Question in Criminal Law in Florida
18 year old charged in New Jersey with underage drinking (disorderly person) 2c:33-15 after 18 year old friend called 911 for ambulance when first kid was non-responsive after frat party. They followed protocol in the NJ 911: Lifeline Legislation protecting underage drinkers from prosecution when calling 911 for alcohol emergency (gave name, cooperated with police, etc). She now has a court date. Will judge be required to drop charges per this legislation or could he still choose to convict her of the misdemeanor or a lesser municipal charge which would still incur fines?
