Legal Question in Criminal Law in Florida

My 17 year old daughter was shot and killed October 4,2008, by a man she did not know. He said he thought he took all the bullets out of the .44 magnum revolver before he pointed it at her head and pulled the trigger. He pled guilty to manslaughter by culpable neg. he was sentenced to 15 years in Florida State prison. He had also been charged with delivery and poss. of Roxicodon before he killed my daughter,but was not arrested for it until a month after he killed my daughter. The state attorney Nolle Prosse the drug charges after he was sentenced to prison.Now the killer of my daughter has filed a Motion to reconsider his sentence. How often are these granted?

First, I'm very sorry for your loss. However, these motions are very rarely granted. I'd say with the facts you described you have nothing to worry about; but you should stay in contact with the prosecutor so that you yourself can object to any reconsideration of the sentence and explain to the judge your feelings on the matter.

What were the circumstances of the shooting? What type of property was she on when she was shot? If he was a stranger to her and the property was in a high crime area or had other violent incidents on it, you may be able to sue the landowner for negligence.
