Legal Question in Criminal Law in Florida
If a 20 year old male is stopped by the police saying no light on the back of his bike is the cause and he is about to be let go but a officer stops him because he sees something on the ground can he be charged with that ? he was out pass his curfew because he was on probation , and now the police are trying to throw 0.6 oz of crack cocaine on him.

Under these facts, if true, the officer is allowed to conduct the initial stop. There isn't enough information here to say why the police is accusing the person of having possession of the cocaine. Are they saying they saw the person throw it? By the very least, the officer probably has a sufficient basis to at least ask the person about the cocaine that is in plain view.
