Legal Question in Criminal Law in Florida

12 year old VOP warrant

My husband was arrested this afternoon, after being stopped for an improper U-turn, on a 12 year old warrant for a criminal mischeif charge when he was 24 years old. He believed that he had completed his probation requirements at that time and has since been pulled over for a few minor traffic infractions and has even recieved a passport to work out of the country within the last few years. There was no record of this VOP prior to 2008 according to the jail where he is currently being kept awaiting transport to another county in FL. They have no bond available and we are told we have to wait for him to be transffered to Leon county in order to get any further information. Is there any other recourse we can take other than him sitting in jail for 10 days or more just waiting to be transferred. He was not even arrested back in 97 when this incident leading to unsupervised probation took place. He was swinging from a stop sign and it fell over. That was his mischeif. Now he is sitting in jail for an unknown period of time. Any help would be apprecieated.

Re: 12 year old VOP warrant

You can contact an the state attorney's office in Leon County to see if they will agree to drop the case and relay that to the court in order to lift the warrant. Or, you may need to hire an attorney in Leon County to attempt to do the same thing. You could also try to get Leon County Sheriff to expedite picking him up ASAP to try to move this thing along.

Without action from Leon County your husband will have to sit and wait to see if they come to pick him up. If they don't come he will be released.
