Legal Question in Criminal Law in Florida
I am 19 years old and was charged with possession of alcohol under 21 in St. Pete, FL. I was not holding the beer, it was in front of the towel i was sitting on. I did not get arrested and was not breathalyzed. I also have a clean record. What do you think the consequences will be?

The maximum penalty for a first offense Possession of Alcohol by a Minor (second degree misdemeanor) is a fine of up to $500, mandatory court costs, 60 days in jail and 6 months of probation. You may be eligible for Pretrial Intervention. Otherwise, the State may offer to resolve your case with adjudication withheld, the imposition of a fine and court costs, community service and probation. The weight of the evidence against any criminal defendant should determine whether or not a plea of not guilty or no contest should be entered and can influence what the sentence will be once a plea is entered.
