Florida law states under section 794.05 that it is illegal for a person aged 24 years or older to engage in sexual activity with a 16 or 17 years old. Sexual activity means any sexual contact such as oral, vaginal, or any union with sexual organs.
This law does not apply if the teen has been emancipated under Florida law and Florida Statute 743.
If contact results in the teen getting pregnant, then paternity must be determined and if defendant is found to be the father, then child support must be paid under the law.
