Legal Question in Criminal Law in Florida
If I accepted a plea deal in Florida on a felony case, Can I overturn it or get my sentence reduced??"
1 Answer from Attorneys
Generally speaking no. You could withdraw your plea if there are grounds that the judge did not do a proper plea colloquoy, but even if you could prove that, it means that you are asking the court to go to trial. Also, you could ask the court to lessen sentence so long as it is done within 60 days of sentencing. This is very hard to do and is usually only done if there are a change in circumstances that wasn't discussed at the original plea. If you think about it, you are asking the judge to overturn something that the judge already felt was an appropriate sentence. So, yes it is possible but difficult. You should contact an attorney to see if one of these would be appropriate for you.
