Is the act of "being high" a criminal offense in Florida? Is it considered "possession by consumption"?

FL law addresses disorderly intoxication, BUT a police offficer would still be tempted to arrest you and the prosecutor would be attempted to file charges. Basically even if there is no such law, the could still make it a royal pain the you know what.

No. Being under the influence of an intoxicant is not a crime. However, being under the influence and being disorderly in public can be a crime. Being under the influence to the extent your normal faculties are impaired while driving can be a crime. And the act of possessing an intoxicant that is also a controlled substance can be a crime.
