Legal Question in Criminal Law in Florida

Hi, I was adjudicated guilty of Possession of a Controlled Substance in 2010 and have no prior criminal history. This charge is classified as a 3rd Degree Felony. My question is, can I have this record sealed or expunged? Its really hurting my employment opportunities and I've made great, positive changes and improvements in my life and I deserve to have a good job. Thank you for your answer.

If you were adjudicated guilty then the answer is no, you can't get your case sealed or expunged. If you have had any case adjudicated guilty then you are not eligible for this kind of relief. On the other hand, if adjudication was withheld and you have never otherwise been adjudicated guilty of any other crime, then you are eligible to get the case sealed. Although a sealing is not as good as an expungement, legally you can still deny or fail to acknowledge the arrest and it is no longer a public record. If the case is sealed for 10 years and you stay out of trouble then you can get it expunged.
