Re: Adjudication withheld
Hello: That phrase means the Judge in a criminal case is sentencing the Defendant but...is withholding an adjudication of guilt. Thus, the Defendant is not convicted for that charge. We are always seeking a Withhold of Adjudication of guilt. It is usually only available if the State attorney agrees with that disposition and/or the Court states it will offer that. Also, it is usually available if defendant has no prior record...or the State has an unprovable case and just wants some disposition without dropping the case. The opposite of a withhold is an Adjudication of Guilt...which means the person is convicted of that charge. 'Hope this helps. Tom Rosenblum
