Legal Question in Criminal Law in Florida

Adjudication withheld

What is the definition of '' Adjudication Withheld''.?

There is a site somewhere to get forms ( do-it-yourself ) to get this off a criminal background check. What is the procedure to have this erased from the court records so it doesn't appear when some runs a check ?

Do you know of the site in which you purchase the paperwork to start getting this off the record ?

Re: Adjudication withheld

Adjudication withheld is the judicial equivalent of the court not entering a verdict of either guilty or not guilty. It is often connected with an agreed plea to the court in criminal matters.

Under Florida law, you are entitled to have your record expunged where all mention of the previous entry is technically "erased" providing you have not been found guilty of any crime and the seriousness of the offense for which an adjudication was withheld falls within the parameters of Florida Statute 943.0585. The law has been changed by the recent legislative session. If you contact my office and provide me with either an email address or a fax number, I will be happy to forward a copy of the recent enactmemt to you. All forms necessary to file for an expungement should be available from the office of the Clerk of the Court in your area at no charge.

This is a serious legal matter and your should consult an experienced criminal attorney with the specifics of your matter to see if you qualify and to guide you in handling an expungement of your criminal file.
