Legal Question in Criminal Law in Florida
My ex admitted to previously recording me so is it okay that I recorded a phone conversation since the expectation of privacy was already violated. Also if he says during the conversation that he wish he was recording it can it be used in Florida.

You can't respond to a crime by committing a crime yourself and just calling it even. It doesn't work that way. At this point he can be prosecuted. However if you do the same now you are subject to prosecution.
