Need Advice

If someone has downloaded some illegal photos from the web, but it was done on a computer that multiple people have access to, can they charge everyone that had access to the computer with downloading the photos?

I recently had the opposite situation; while several people had access to the computer, only the registered ISP address owner was charged. He said it was done by others with access, but given that as the owner he is probably responsible for the use of others to whom he granted access, the charges stuck; though he had a decent defense.

I don't know if the authorities in your case will proceed the same way, but it is a reasonable way to go. While I'm sure the other users COULD be charged in addition to the ISP owner, I would be surprised if they were, unless the registered owner knows who did it and informs the police.

Obviously there's an available defense, but given the stakes involved, it is important you contact an attorney to best position yourself right away, in hopes of fending off a real problem. If the pictures are sexual in nature, its possible someone found guilty of certain sex crimes could be branded as a sex offender as a result. If the person charged is faced with that risk, it would be worth moving heaven and earth to avoid such a severe result.
