Aggravated Batter w/ Deadly Weapon

I get into my car as soon as I see the victim pull out a knife. Apparently, she ran down the block to get a group of guys to the scene. While I'm on the way out, I stop my car and exchange words with one of the guys. In the meantime, while I'm looking outside of the driver window, the girl ran to the front right side of my bumper and I hit the gas. The car pushed her away and she got a scrape on her knee and palms. I left the scene and police arrested me the next day. I served 5 days in jail and Im out on $25,000 bond and house arrest until my court date, which is 3 weeks from now. What are the possible consequences with no prior record?

If the State files Aggravated Battery, that is a second degree felony and the maximum sentence would be 15 years in prison. The florida sentencing guidelines (without any prior record) would be minimum 21 months Florida State Prison to 15 years Florida State Prison. It could be more if the victim was actually injured.

The State will not necessarily charge you with the Aggravated Battery for which you were arrested. You should consult an experienced criminal attorney in your area to try to get the charge reduced prior to filing based on the circumstances. Good luck.
