Legal Question in Criminal Law in Florida

aggravated battery w/ great bodily injury

I got arrested in florida and charged with the above charge which is a felony 2. the reason I believe I was arrested is because of the fact that I was running away from the incident and ran into a group of police. there were three of them and one of me, they jumped me but I hurt one of them fairly bad. the police would only take statements from them and there friends and didn't seem interested in the fact that I had been injured at all, what should I do. I am a military man with two years service in iraq as well as 12 years in service, I am married with three lovely children. I don't think I deserve to go to jail for getting attacked.

Hello:

I read your post, you do not seem to ask a question. Nevertheless, I would agree with the other 2 responses. It's hard to advise you without having more facts. Such as do you have any prior criminal record? Has the case been filed by the State Attorney's Office? If so, have you made a court appearance yet?

If you do not have a prior record, and no one was hurt that bad, the case may be bumped down to a misdemeanor. If they leave it a felony, you want to ask what the State is offering as a plea agreement. You want to make sure they recommend to the court that Adjudication of Guilt is withheld. That means it is not a felony conviction.

If the State is offering a plea to a lot of jail time, you may want to fight the charge. That would entail deposing the State's witnesses to expose lies, get some statements that may be inconsistent (hurts the witness' credibility), find out what he/she would say at a trial. You never know, the State may be bluffing about how good of a case they have and will give you a decent offer to plead to on the eve of the trial.

'Hope this helps. If you need any assistance in North Fla. give my office a call. Tom Rosenblum

My best advice to you is too obtain a good criminal defense attorney from the area where you were arrested.

If it is in Central Florida please feel free to contact me at www.richardhornsby.com. If it is in another part of the State I will be happy to refer you to a qualified individual.

Re: aggravated battery w/ great bodily injury

You need to get a Florida lawyer in the location where the event happened. The lawyer can argue your case to mitigate the circumstances or claim self-defense.
