Legal Question in Criminal Law in Florida

ajudication

I was convicted of a felony charge 6 years ago. In the plea bargain they with held ajudication. My lawyer at the time said if I applied for a job I could legally say I was never convicted of a felon. I recently was job hunting and my record came up to my prospective employers. Now I'm being told I have to have my records expunged! Should the charges have showed up on my record? Do I have to now pay to get them ''expunged'' ?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Once charges are filed, they will always show up on your record regardless of whether adjudication was withheld or not. You do need to seal or expunge your record to clear this item. It can only be done if you have never been convicted in any criminal matter.
