Legal Question in Criminal Law in Florida

ammunition

My friend was pulled over while in a borrowed car. He was only moving it in a parking lot. (He was not the one that borrowed it but it was known he'd be riding in it.) The owner left gun shells in the glove box. My friend didn't have a license and is a felon. The police searched the car and found the ammunition. They charged him with having a concealed Firearm. Can they convict him if he didn't know they were there?

Re: ammunition

If the state is able to prove the underlying felony conviction(s), then your friend cannot have possession of the ammunition.

In order to prove "possession" the state must prove that 1.) the ammunition was within "ready reach" of your friend, and 2.) that your friend had knowledge that it was there......

hope that helps,
