Legal Question in Criminal Law in Florida
Animal and Domestic Pets
Stuation: neighbors report to me(the owner),they observe(witnessed)an off duty deputy police(and reside
resident neighbor)...
1-take,confined and carry away
2-my pet(a domestic indoor/outdoor cat)
3-by force and intimidation
4-drive off the residential property, then deposit and abandon at a busy major highway, with the(apparent)intent to permanently deprive the owner(myself) of my pet(property).
To the best of my layperson's abilities, as to understanding the law, the actions of this person equate to all the components and/or elements required by any state prosecution to prove(beyond a reasonable doubt)that a "robbery" has been committed.
Please advise to whom I would address my concerns to.
(the agency for such matters, and behavior of law enforcement). I am not seeking court, but just to air my concerns of such questionable behavior.

The cat is property. You were not placed in fear or intimidated etc... This crime would be classifed as a theft, and probably a petit theft, a misdemeanor. If you so choose you could report this to your local police, and they will in turn file the report with the State Attorneys Office. Depending on how hard core the SAO is then maybe, (stress maybe) they might file charges.
