Legal Question in Criminal Law in Florida
Appeal due to poor legal representation
My nephew plead guilt to sexual battery because he was encouraged to do so by his public defender.
He was not guilty but was afraid he would receive a very long sentence at trial. Where do I start to help him appeal or request a reduced sentence. He has served 2 years of an 8 year sentence.

The hard part of your nephew's problem is that
he entered into a contract with the state and that
contract is just as hard to break as is a contract
for aluminium siding. "Buyer's remorse" doesn't go
very far.
Only if your nephew can show that he received
inadequate representation can he hope to reopen it
now. Did his lawyer investigate all the facts? He
will have to show specific inadequacies in the acts
of his counsel.
