Legal Question in Criminal Law in Florida

In an appeal I worded something wrong that confused the courts... Can I Amend my motion? The judges secretary said I couldn't. That I had to attend a hearing to determine what I meant.... That sound rediculas. This is a misdameanor case.

Your case is a perfect example of why one should hire an attorney to deal with their legal issues. Appellate rules are very strict, no matter how ridiculous they sound. Just as an example, there are innocent people in prison for murder where the supreme court has said that because a brief was filed one day late, it's too bad. That all said, you can ask the court to amend your motion, they might allow it. It can't hurt to ask. Good luck.
