appeals

my husband filed a post conviction relief and it was denied.what do we do next and how do we accomplish this? He was never notified of the denial,so he has nothing stating he was denied. I called and was given this information on the phone.

He needs to file a "Notice of Appeal" within 30 days after the date of the order denying the motion. You really need to retain an attorney to conduct the appeal. You may call me if you need further information.

So many prisoners hurt themselves by filing important 3.850 motions without the aid of an attorney. These post conviction relief requests (in my opinion) must be done by a competent criminal defense attorney. If your husband wants to try every avenue available - seriously, and i mean seriously, hire an attorney. It is extremely important not to file these motions "from the hip."
