Legal Question in Criminal Law in Florida
Hello. An application I am filling out says the following: �Have you ever been convicted of a crime or received a verdict of anything other than "not guilty" for any criminal or traffic offense (misdemeanor or felony) for which the records have not been expunged or sealed?"
I have misdemeanors but was given adjudication withheld with probation. I violated my probation and had to report back to jail. Does my verdict still count as adjudication withheld? How would I answer the question on the application? Do I select the �yes� or �no� option?

It depends. If you were adjudicated guilty after being violated then you will have to report it. If you weren't then you can honestly say you have not been convicted of anything. One caveat though is that the arrest on the VOP will still show on a background check so it is advisable to get your charges sealed. You should talk to an attorney right away as the process takes several months and it will be helpful in the future.
