Legal Question in Criminal Law in Florida
If someone has you arrested on battery, without evidence, can they drop the charges (via phone) before the scheduled court hearing.

The alleged victim cannot drop the charges at all. Only the state's attorney can drop the charges before trial. If the alleged victim does not wish to prosecute and wants the charges dropped, he/she needs to call the state's attorney and let them know. Just because the alleged victim makes that call does not necessarily mean that the charges will be dropped.
