Legal Question in Criminal Law in Florida
I was arrested for failure to sign a citation a misdemeanor. However the officer forgot to have me sign the citation and issued it to me( I still retain the original copy). The officer shows up to my residence at midnight 3 hours later beating on the door and shinning his light in all the windows and not Identifying himself so i did not immediately answer. He stated that he just wanted me to sign his citation so i opened the door and he was noticeably agitated and he presents me with a new citation. He asks me if I will sign and I say Yes.He then asks me where my original is and i tell him i have misplaced it and he then arrests me for failure to sign a citation. My question what Is an appropriate defense?
1 Answer from Attorneys
The story you just gave is your defense. The question is can you handle this on your own. Possibly. However, you should consider hiring an attorney to fight this case. There's a saying that a doctor wouldn't operate on himself; the same applies to the law. Would you really want to operate on yourself in a courtroom when your liberty is at stake? Just something to think about.
