Legal Question in Criminal Law in Florida

arrested in florida
my mom has been arrested because my father told police that my diabetic very sick mother was beating on him.The night before my mother called the police on him 4 harrassing her and being drunkwith a gun in the house. they even had 2 come back a second time and its documented. They have been separated 4 over 20yrs last year my mother decided to stay with him and maybe take care of each other because the lady (he met in the mental hospital where he was commited for a year) he was living with him died. Now after throwing all the food out (she needs it being diabetic) and terrorizing her to the point she has to run out the house and a neighbor seeing this and had called the cops. How is he able to get her arrested( while arrested she had to go to the hospital in their custody) and be free to go home? i live in N.Y. and i'm heading to florida to help my mom. I need help on this please
