Legal Question in Criminal Law in Florida
I was arrested for petit theft, I pleaded no contest and was given a fine. There were no prior`s. I would like to know if this stays on my background check and if so can I get it removed.

Depending on the exact disposition (resolution) to the case, you may be able to seal or expunge the record. If you did a diversion program, you could potentially expunge the record. If you plead No Contest and received a withhold of adjudication, you may be able to seal the record, which means only law enforcement would be able to see the record and it would be "sealed" from public view.

The arrest will remain on your record until you take action to have it removed. But you have to meet the eligibility requirements to seal or expunge first. Basically, can you answer "no" to these 3 questions:
1. Have you ever been convicted of a crime before (adjudicated guilty)?
2. Have you ever sealed or expunged a record before?
3. Are you currently under court supervision?
If the answer is "no" to the above, and you received a withheld adjudication you can seal. If the charge was eventually dismissed through PTI, you could have it expunged.
