Legal Question in Criminal Law in Florida
arrested for possession
My boyfriend was arrested and charged with poss/pur/sell/deliver cocaine. He wasn't selling drugs though and when arrested the police found no drugs on him and no money on him or in my house. The judge offered him 20 months. He went to prison in 2003 for attempted burglary. Can he go back to prison with no evidence against him just being identified as the man in blue jeans and a blue shirt who sold drugs to a cop?

What county is this? He really needs an attorney to represent him. The short answer is that he can go back to prison. They may offer him a plea to probation if the think the evidence is weak. He needs to be careful about doing that because if he violates probation he could be sent to prison for an even longer time.
