Legal Question in Criminal Law in Florida

I was arrested in 2003 for resisting arrest w/o violence. The judge withheld judification, I paid court fees and that was it. Will that show up on a background check or do misdemeanors fall off your record after a period of time? If not what will a it being exsponged do?

It will show up in a background check. And yes, it can be expunged. However, even with expungment, it could still show up in a background check. Companies that do background checks get hold of these records as soon as they are made and they get in the public domain. Expungment will get it off the clerk's records, and LE agencies, but they are not the only people to keep the records.

I apologize. I should have said you could have the record sealed, not expunged. You have to wait at least 5 years after sealing to expunge it.
