Legal Question in Criminal Law in Florida

Arrested for sale of alcohol to Minor ATF

When i was arrested for selling alcohol to a Minor by the ATF, the ATF agent who filled out the paperwork he put the wrong date of birth he wrote 07/06/1986, but my real birthday is 07/05/1985. Should i be concerned when getting this expunged from my record for the false information given. The case is already closed, but what should i do? Just keep on using the wrong Bdate or use the correct when and mess up the filing process. And if its under the wrong Bdate, should i not even get it expunged, because it would be somebody else?? Thanks for your help.

You should use the correct date but make a note that the improper date was used in the arrest form. You want to make sure that your pleadings specifically refer to you, your case, and your correct information.
