If an individual makes a threat to touch or strike you, that is either harmful, or offensive, it may be an asault or even an aggravated assault.

Assault occurs where the individual makes the threat in an immediate time frame. The key is immediate: A phrase like "One day, I'm going to smack you down" would not be immediate - it would be a threat of a future, uncertain act of physical aggression.

There also must be the apparent ability to do so - a threat to immediately hit you with a stick in hand is illegal, a threat to hit you with a stick that isn't there isn't.

The stick, club, knife, gun or other implement often means the difference between a misdemeanor and a felony.

Given what you now know, you may wish to report this incident to the police.
