Legal Question in Criminal Law in Florida
Attempted Armed Robbery
My Husband was picked up in the early morning hours carrying a gun because someone said he was lurking around acting like he was going to rob someone.
They have had him in jail since Nov 9 and have charged him with 2 counts of attempted armed robbery. Felon is possesion of weapon and resisting arrest. They have one witness and no other evidence but the gun. What kinda of time is he looking at and how can we fight the attempted robbery??

Re: Attempted Armed Robbery
Based on your description, if there is no alleged victim then there can be no robbery. Still he is a felon in the possession of a firearm? In florida that's a 3rd degree felony punishable by up to 5 years in jail.
