Legal Question in Criminal Law in Florida
For an attempted murder charge is it mandatory that you give two theories? One premeditated murder & two felony murder , as jury instruction to juries?
(In the body of the information, it alleges premeditated attempted murder by defendant shooting into a vehicle, then occupied by victim. However the shooting in a occupied vehicle is not charged (charged dropped) but the attempted murder is. How can this be if fist, in order to sustain conviction for attempted murder you must place the victim inside the vehicle.)
