Legal Question in Criminal Law in Florida
My attorney took funds that were to be given to me from a settlement and forged my name and deposited the money into his account without my knowledge. Is this grounds for disbarment
1 Answer from Attorneys
Depending on your agreement with the attorney, you may have given him authority to endorse the check on your behalf and deposit the funds into his trust account. Regardless, you should confirm that the settlement check went directly into the attorney's trust account and that he is paying you what is due to you. If the money went into any account other than the trust account and/or the attorney has used those funds for personal use or otherwise refused to turn over your share of the settlement, that would be an issue that would potentially subject the attorney to discipline by the Florida Bar.
