Legal Question in Criminal Law in Florida
In August I was arrested for posession of a controlled substance without a prescription. I did have 2 oxycodene in the bottom of my purse. I have been in drug court and am doing well - however my mom up in NY has become very sick. I checked into being transferred but I was told FL does not transfer drug court cases outside of FL. I was checking into pleaing no-contest and was wondering what the aftershock would be. with drug court my record would be clear but I was wondering if I were to plea no-contest would I have a felony on my record? I would not plead to the charge if there is any way to avoid it. You would have a felony on your record, even if you got a withhold, and you would probably have to do probation. You would probably still have a problem transferring the probation. With drug court, you should get the charges dropped when you complete the program and you can do whatever you want to do. Please talk to your attorney before making a decision.
You should ask permission to travel to go see your mother. If you plan on not coming back for a long time see if you can do an expedited course, they will do that depending on the facts of the case. I'm certain there will be a drug testing facility that will mail the results to court. It doesn't hurt to ask the court to accommodate you. I wouldn't take a plea, you will have a criminal record that very well could follow you.
