Legal Question in Criminal Law in Florida
Back Ground Check
There was a question on a Application which stated, Have you been convicted of a Felony or Misdemeanor? I answered No, My back ground came back, because i answered that question with a No they indicate to me i lied on an application by not aswering Yes, Why should i answer Yes when im not a convicted Felon. I think the question should have been worded differently.

We get this question all the time on lawguru, and I've spoken to several people in my office on this issue. I assume you received a "withhold" of adjudication, yet they say you are wrong, that you are "convicted" and that you lied. Florida law is on your side, and the statute says you can lawfully deny a conviction on a job application. Nevertheless, I see your situation all the time.
