Legal Question in Criminal Law in Florida
bail reduction
my boyfriend is in jail his bond was set at 100,000.00.we cant afford to get him out at that price even witha bail bondsman. we asked his attorney to get him a bail reduction hearing so maybe we'd be able to get him out on a much lower bail. he had court on oct.12th the day we requested his attorney to set up a hearing it's now the 28th of oct. what is taking so long to get a bail reduction hearing? he has to go back to court on the 13th of nov. for his pre-trial status.whats the process in which an attorney has to go through to get one? it really seems to me like she isnt doing her job she's never even gone in to get his side of the story she's only going on things that he's told me and then i tell her. he's seen her once but it was in court and all they talked about is getting his bail reduced. how do i know if she's really doing her job? and if not we've already paid her i dont have the money to get another attorney??

It can take months to get a bond hearing date. You can fire her, but he'd need another lawyer. My fees are always non refundable.

It can take quite some time to get a hearing scheduled in a court. While the court will try to accomodate an attorney's request, it has to work the hearing in with all other matters that are already scheduled and new ones which come up and must be dealt with in a timely fashion. It is not unreasonable for it to take several weeks or longer to get the hearing scheduled.
If your boyfriend is not happy with his attorney, then he should call the attorney's office and voice his concerns. He should request an immediate conference with the attorney at the jail to discuss his case and to review all options. He should make notes of all issues which concern him and be sure to address everything when the attorney comes to visit. If he was to fire his attorney, he would probably not get any money back and then he would not have money to hire another attorney.
