A battery is a first degree misdemeanor
A battery is a first degree misdemeanor punishable by up to one year in county jail and is defined as an intentional touching of another person without their consent. If a weapon is used, there is serious bodily injury or the touching is against one who is pregnant or elderly, the charge rises to aggravate battery, which is a second degree felony punishable by up to fifteen years in Florida State Prison. A felony battery is a third degree felony punishable by up to five years in Florida State Prison and is charged when the battery causes severe bodily harm or permenent disfigurement.
