Battery on a Law Enforcement Officer
If I am arrested for battery on a law enforcement officer, but was too intoxicated to even remember the event in question, can I get a lesser charge? Wouldn't the crime have been unintentional? If I am unable to understand what I am doing? Can I still be held responsible? I honestly don't recall every striking the officer, nor do I remember the period of time during which this battery was supposed to have taken place. About the only thing I do remember is the actual arrest itself, which is very vague. I remember being grabbed by the throat in such a way that it was sore for 5 days after. This is all I can recall. Please advise.

No, voluntary intoxication is not a defense.
