Legal Question in Criminal Law in Florida
Battery on a minor
My 7 yr old son (who only weighs 43 lbs) was struck in the head by an adult (65 yrs old+) as he walked passed him. My husband popped the man in the jaw in retaliation. Is there a stronger punishment for battery on a child than an adult if both are considered ''misdemeanor battery''? I feel like his punishment should be much harsher because our son cannot defend himself...which is why my husband did it for him.

No the degree would be higher if the injuries were more severe.
